Actually, the First Amendment doesn't get in the way. The Supreme Court has ruled in the past that commercial speech does not enjoy the same protections as free speech. When there is a "compelling public health interest," ads can be banned -- witness the lack of cigarette advertising on TV. If there isn't a compelling public health interest in banning all tobacco advertising and promotion, I don't know when there would ever be one.
