frivilous clauses in prenups

A prenup is mean to handle matters of finances,not health. Those "clauses" are an abuse of the prenuptual agreement. Like someone else said, if smoking or weight are an issue, then don't get married in the first place.

This might not be the mate for you

If you start adding stipulations that allow a way out, you might ought not get married ! How about a clause that if you lose a limb or a breast or develop a scar or are injured in an accident???? This is stupid. If smoking bothers you, this person is not your ideal mate - DON'T GET MARRIED ! Smoking causes cancer & heart disease - this isn't the person for you. Breast cancer can develop or uterine or prostate or testicular. Its just as hard to watch someone die from that. The VOWS SAY IN SICKNESS AND IN HEALTH, FOR RICHER OR POORER. Don't take them if you can't live by them.

For someone who lost a spouse to lung cancer, heart disease, or some other disease that could have been avoided with a lifestyle change, I can see a health stipulation as part of a pre-nup. It's hard enough to go through the loss of a loved one when there was nothing you could have done about it, but to watch all of the warning signs re-appear the second time around when you could have prevented it is probably more than most people can take.
